Terms of Use
These terms govern your use of apps published by Echo Development LLC ("Echo," "we," "us") and of this website. By using our apps, you agree to these terms and to Apple's Standard End User License Agreement. If there's a conflict, these terms control to the extent Apple's terms allow.
1. Health and fitness disclaimer
Our fitness content is for general information and education. It isn't medical advice and doesn't replace advice from a doctor or other qualified professional. Talk to a doctor before starting any exercise program, especially if you are pregnant, injured, or have a medical condition. Stop exercising right away if you feel pain, dizziness, or shortness of breath. You exercise at your own risk, and you're responsible for using proper form, suitable equipment and a safe space.
2. Your account
You must be at least 13 years old, and old enough to consent to data processing where you live, to use our apps. You're responsible for activity on your account and for keeping your device and Apple ID secure. Give us accurate information and let us know if you think your account has been misused.
3. Subscriptions and payments
- Some content requires a paid, auto-renewing subscription, which may be sold per creator or per program. Prices and billing periods are shown in the app before you buy.
- Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel subscriptions in your Apple ID account settings. Canceling takes effect at the end of the current period.
- If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
- Refunds are handled by Apple under its policies.
4. Content and license
The apps and their content, including workout programs, videos, text and graphics, belong to Echo or to the creators and licensors who provide them, and are protected by intellectual-property laws. We give you a personal, non-transferable, revocable license to use the apps and content for your own non-commercial use. You may not copy, record, redistribute, resell or publicly perform the content, or try to reverse-engineer, scrape or interfere with the apps.
5. Creators
Programs in our apps are created by independent fitness creators. Their views are their own. Creators don't have access to your personal account data; see our Privacy Policy.
6. Acceptable use
Don't use our apps to break the law, harass anyone, infringe others' rights, upload harmful code, or get around security or access controls. We may suspend or end access for anyone who violates these terms.
7. Changes and availability
We may update, add or remove features and content, including individual programs, at any time. We may update these terms; if a change is material we'll tell you in the app or by email, and continued use after the change means you accept it.
8. Disclaimers
Our apps are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we don't promise any particular fitness results.
9. Limitation of liability
To the fullest extent the law allows, Echo won't be liable for any indirect, incidental, special, consequential or punitive damages, or for personal injury arising from exercise you choose to do. Our total liability for any claim relating to the apps is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not apply to you.
10. Governing law
These terms are governed by the laws of the state in which Echo Development LLC is organized, without regard to conflict-of-law rules, except where the law where you live requires otherwise.
11. Apple
These terms are between you and Echo, not Apple. Apple isn't responsible for the apps or their content, has no obligation to provide maintenance or support, and isn't responsible for any product claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
